These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "Patient," or "you") and Cura Welt governing your access to and use of our website, platform, and all associated services.

By accessing or using the Cura Welt platform in any manner — including browsing the website, submitting an inquiry, registering an account, or engaging with any facilitation service — you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

If you do not agree to these Terms, you must immediately cease all use of the Cura Welt platform and services.

These Terms apply to all visitors, registered users, and any other persons who access or use the platform. Where applicable law requires affirmative consent, your continued use of the platform constitutes such consent.

Cura Welt is an international medical tourism facilitation company that connects patients seeking healthcare abroad with vetted partner clinics located in destination countries of the patient's choice around the world.

Cura Welt operates globally, facilitating access to healthcare services in multiple countries. The availability of partner clinics, procedures, and services may vary by country and is subject to change.

Cura Welt provides facilitation services only. Our platform and team assist patients in identifying and connecting with suitable international healthcare providers based on the patient's needs, preferences, and chosen destination country. Our services include, but are not limited to:

• Matching patients with vetted partner clinics based on their medical inquiry and chosen destination country
• Providing general, non-clinical information about partner clinics, including available procedures, accreditations, and general pricing ranges
• Coordinating communication and initial contact between patients and partner clinics
• Assisting with logistics such as general travel guidance, accommodation suggestions, and appointment scheduling coordination
• Providing general educational content about medical tourism procedures and destination countries
• Offering patient support throughout the coordination process

All clinical services are arranged directly between the patient and the partner clinic under a separate agreement governed by the clinic's own terms, applicable professional standards, and the laws of the relevant jurisdiction.

Cura Welt is not a licensed medical or healthcare provider. Nothing on our platform, in our communications, or through our facilitation services constitutes medical advice, diagnosis, prognosis, treatment recommendation, or clinical guidance of any kind.

You acknowledge and agree that:

• All information provided by Cura Welt is for general informational and facilitation purposes only
• You must consult a qualified physician or medical professional in your home country before making any medical travel decision
• Cura Welt does not evaluate your personal health condition, medical history, or suitability for any specific procedure
• Any clinical assessment, diagnosis, or treatment recommendation is solely the responsibility of the treating physician at your chosen partner clinic
• Medical procedures carry inherent risks and complications — Cura Welt bears no responsibility for clinical outcomes, complications, post-operative care requirements, or any health event arising from treatment received at a partner clinic
• You are solely responsible for providing accurate and complete medical information to any partner clinic you engage with through our platform

To use Cura Welt's facilitation services, you must meet the following eligibility requirements:

• You must be at least 18 years of age. If you are registering on behalf of a minor, you must be the minor's legal parent or guardian and you accept full legal responsibility for all use of the platform in connection with that minor.
• You must have the legal capacity to enter into a binding contract under the laws of your country of residence
• You must not be prohibited from using our services under applicable law
• If registering as a legal entity, the individual registering must be duly authorized to bind that entity to these Terms

Account Accuracy

If you create an account or submit an inquiry, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at contact@curawelt.com of any unauthorized use of your account.

Cura Welt reserves the right to suspend or terminate accounts where eligibility requirements are not met or where false information has been provided.

As a user of the Cura Welt platform, you agree to the following responsibilities:

Medical & Personal Honesty

• Provide truthful, complete, and up-to-date information about your health status, medical history, and treatment needs
• Disclose any known allergies, medications, prior surgeries, or contraindications to any partner clinic you are referred to
• Ensure you are medically fit to travel and obtain appropriate medical clearance from your home country physician prior to travel

Travel & Legal Compliance

• Obtain all necessary travel documents, visas, and medical travel insurance appropriate to your destination country
• Comply with all immigration, health entry, and regulatory requirements of the destination country
• Understand and accept that you bear full legal responsibility for your travel and healthcare decisions abroad

Platform Use

• Use the platform solely for lawful purposes consistent with these Terms
• Refrain from misrepresenting your identity or the nature of your inquiry
• Not use the platform to solicit services outside the agreed facilitation scope

Cura Welt maintains a network of vetted international partner clinics. While we apply reasonable due diligence in selecting and onboarding partner clinics — including reviewing accreditations, regulatory licensing, and patient feedback — we make no warranties, representations, or guarantees regarding:

• The quality, safety, suitability, or outcomes of any medical service delivered by a partner clinic
• The continuing validity of any clinic's medical licenses, accreditations, or compliance status at any given time
• The accuracy of information provided by partner clinics to Cura Welt or published on our platform
• The conduct, competence, or professional standards of any physician, surgeon, nurse, or clinical staff employed by a partner clinic

Cura Welt may also reference third-party service providers for travel, accommodation, translation, or insurance. We are not responsible for the services, conduct, or availability of any such third parties.

Cura Welt operates on a commission-based business model. We receive referral commissions from partner clinics for successfully facilitating patient referrals that result in booked consultations or procedures. This commission is paid by the partner clinic and does not represent an additional charge to the patient.

Transparency Commitment

We are committed to transparent commercial relationships. You acknowledge and accept that:

• Cura Welt receives financial compensation from partner clinics upon successful patient referral
• This compensation arrangement may influence which clinics are featured or recommended on our platform
• The prices quoted by partner clinics are set independently by those clinics and are not determined by Cura Welt
• Cura Welt does not mark up, add fees to, or otherwise modify the pricing of any medical service offered by a partner clinic

Patients are encouraged to independently research and verify the qualifications and pricing of any clinic before booking medical services.

Cura Welt's platform facilitation is provided to patients at no direct charge. Any payments for medical procedures, consultations, deposits, or associated services are made directly to the relevant partner clinic, subject to that clinic's own payment terms and cancellation policies.

Patient Responsibilities

• Review and understand the partner clinic's payment terms, deposit requirements, and cancellation or refund policy before committing to any procedure
• Ensure all financial arrangements are confirmed directly with the partner clinic in writing prior to travel
• Understand that Cura Welt is not a party to any financial transaction between you and a partner clinic

Disputes

Any payment disputes, refund requests, or billing complaints must be directed to the relevant partner clinic directly. Cura Welt may, at its discretion and without obligation, assist in facilitating communication between the patient and the clinic in good faith, but assumes no financial liability or responsibility for any such dispute.

Currency & Exchange

Prices quoted by partner clinics may be in local currency, USD, EUR, or other denominations. Cura Welt accepts no responsibility for exchange rate fluctuations, bank transfer fees, or cross-border payment charges incurred by patients.

Platform Disclaimer

The Cura Welt platform and all content therein are provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not guarantee uninterrupted, error-free, or secure access to the platform.

Medical Outcome Disclaimer

Cura Welt expressly disclaims all liability for any harm, adverse medical outcome, complication, injury, death, financial loss, or other damage arising directly or indirectly from:

• Any medical procedure, consultation, diagnosis, or treatment received at or through a partner clinic
• Any decision made by you based on information provided on the Cura Welt platform
• Any failure by a partner clinic to meet expected standards of care
• Travel-related incidents, including but not limited to illness during transit, lost luggage, or travel disruptions
• Post-operative complications experienced after returning to your home country

Limitation of Liability

To the fullest extent permitted by applicable law, Cura Welt's total aggregate liability to you for any claims arising from or related to your use of the platform or our facilitation services shall not exceed EUR 500 (five hundred euros) — or the equivalent in local currency — regardless of the nature of the claim, whether in contract, tort, or otherwise.

In no event shall Cura Welt be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, loss of goodwill, bodily injury, or death, even if we have been advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, the above limitations apply to the fullest extent permitted by law.

All content, materials, branding, design elements, text, graphics, software, and other intellectual property published on the Cura Welt platform are the exclusive property of Cura Welt or its licensors and are protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the platform for personal, non-commercial facilitation purposes only. This license does not permit:

• Copying, reproducing, redistributing, or publishing any Cura Welt content for commercial purposes
• Modifying, creating derivative works from, or reverse-engineering any part of the platform
• Using Cura Welt's name, logo, or branding without prior written consent
• Scraping, data-mining, or automated extraction of platform content

User-submitted content (such as inquiries, feedback, or reviews) remains the property of the user but grants Cura Welt a perpetual, royalty-free, worldwide license to use, display, and reproduce such content in connection with its services.

Your privacy is of paramount importance to Cura Welt. Our collection, use, storage, and sharing of your personal data — including sensitive health-related data — is governed by our Privacy Policy, which forms an integral part of these Terms.

By using our platform, you consent to the processing of your personal data as described in our Privacy Policy. Key data protection principles we adhere to include:

• Data is collected only for specified, legitimate facilitation purposes
• Medical and health-related data is treated as sensitive data requiring heightened protection
• We only share your data with partner clinics to the extent necessary to fulfill your facilitation request, and with your knowledge
• We implement appropriate technical and organizational security measures to protect your data
• You have rights of access, correction, deletion, and portability over your personal data where applicable under law

Cross-border data transfers may occur when your information is shared with partner clinics in destination countries. We ensure appropriate safeguards are in place for such transfers consistent with applicable data protection laws.

You agree not to use the Cura Welt platform for any of the following prohibited activities:

• Submitting false, misleading, or fraudulent information to Cura Welt or any partner clinic
• Impersonating any person, entity, or medical professional
• Attempting to bypass, circumvent, or interfere with the platform's security, authentication, or access controls
• Using the platform to engage in any unlawful, harmful, or fraudulent activity
• Harassing, threatening, or engaging in abusive conduct toward Cura Welt staff, partner clinic personnel, or other users
• Posting or transmitting unsolicited commercial communications (spam)
• Introducing viruses, malware, or other malicious code into the platform
• Engaging in data scraping, crawling, or extraction without prior written authorization
• Using the platform in any way that competes with or undermines Cura Welt's commercial interests
• Seeking facilitation for procedures that are illegal in either your country of residence or the destination country

Violation of these prohibitions may result in immediate termination of your account, legal action, and reporting to relevant authorities where required by law.

Cura Welt reserves the right to suspend, restrict, or permanently terminate your access to the platform and services at any time, with or without notice, for any reason including but not limited to:

• Breach of any provision of these Terms
• Provision of false or misleading information
• Conduct that is harmful to Cura Welt, partner clinics, or other users
• Compliance with applicable law or a valid legal order
• Cessation of platform operations in a given jurisdiction

You may terminate your account at any time by contacting us at contact@curawelt.com. Upon termination, your right to use the platform ceases immediately. Sections of these Terms that by their nature should survive termination — including disclaimers, limitation of liability, indemnification, and governing law — shall continue to apply.

You agree to indemnify, defend, and hold harmless Cura Welt, its officers, directors, employees, agents, affiliates, and successors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

• Your use of the Cura Welt platform or facilitation services
• Your breach of any provision of these Terms
• Your violation of any applicable law or regulation
• Any medical treatment or services you receive from a partner clinic
• Any misrepresentation or false information provided by you
• Any claim by a third party arising from your conduct in connection with our platform

Cura Welt reserves the right to assume exclusive control of the defense of any matter otherwise subject to indemnification by you. In such a case, you agree to cooperate fully with our defense of such claims.

These Terms of Service and any dispute arising out of or in connection with them — including disputes about their existence, validity, or termination — shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law provisions.

Nothing in this clause shall limit Cura Welt's right to seek injunctive or other equitable relief in any jurisdiction to protect its intellectual property rights or confidential information.

Where mandatory consumer protection laws in your country of residence provide you with rights that cannot be overridden by contract, those rights are not affected by this clause.

In the event of any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Cura Welt platform, we encourage you to first contact us at contact@curawelt.com to seek an informal resolution. We will endeavor to respond to all substantive complaints within 14 business days.

Formal Dispute Process

1. Good Faith Negotiation: If the informal resolution fails, the parties shall attempt to resolve the dispute through good faith written negotiation for a period of 30 days from written notice of the dispute.
2. Mediation: If negotiation fails, the parties agree to submit the dispute to non-binding mediation administered by a mutually agreed mediator before pursuing any other remedy.
3. Litigation: If mediation is unsuccessful, either party may pursue resolution through the competent courts of the governing jurisdiction as set forth in Section 16.

Notwithstanding the above, Cura Welt may seek injunctive or emergency equitable relief in any court of competent jurisdiction to prevent irreparable harm pending resolution of a dispute.

Cura Welt reserves the right to modify, update, or replace these Terms of Service at any time at our sole discretion. We will provide notice of material changes by:

• Posting the updated Terms on our website with a revised "Last Updated" date
• Sending a notification to registered users via email where reasonably practicable
• Displaying a prominent notice on the platform for a reasonable period following the change

Your continued use of the Cura Welt platform after the effective date of any revised Terms constitutes your acceptance of those changes. If you do not agree to any revised Terms, you must discontinue your use of the platform.

We recommend bookmarking this page and reviewing it periodically. The most current version of these Terms always supersedes all prior versions.
